1. About these TermsThese Client Terms explain the general conditions that apply when an individual, parent, guardian, family, school, sports club, community programme, business or other organisation enquires about, purchases or engages services from The Neurodiverse Home™.The Neurodiverse Home™ is operated by The Neurodiverse Home Lifestyle Development Consultancy, a sole establishment registered in Abu Dhabi, United Arab Emirates, under economic licence CN-6418643.In these Terms, “TNDH”, “we”, “us” and “our” mean the service provider named above. “Client”, “you” and “your” mean the person or organisation purchasing or commissioning the service. “Participant” means any child, young person or adult who is the subject of or takes part in the service.2. Where there is a genuine conflict, the service-specific written agreement takes priority for that engagement.Website information and initial conversations are provided for general information. They do not create a paid professional engagement until the service, scope, responsibilities and fees have been agreed.3. Initial contact and consultationThe first WhatsApp or email exchange is normally free. It is intended to understand the reason for contact, identify whether TNDH may be an appropriate service and agree a sensible next step. The initial exchange is not an assessment, diagnosis, consultation, emergency service or guarantee that TNDH will accept the engagement. Please avoid sending full reports or highly sensitive records in the first message unless TNDH has asked for them and agreed an appropriate method.A consultation may be the first paid professional stage. Before a paid consultation is booked, TNDH will explain its purpose, format, fee and any preparation required. No package or ongoing service begins automatically after the initial contact or consultation. Any further paid work will be explained, priced and agreed before it begins.4. 5. Professional scopeTNDH is an independent educational, environmental, participation and implementation consultancy. It provides only the services that fall within the practitioner’s qualifications, competence, licence, insurance and agreed professional scope.TNDH does not provide medical, psychological or psychiatric diagnosis; psychotherapy or counselling treatment; occupational therapy; physiotherapy; speech and language therapy; formal dyslexia diagnosis; regulated clinical behavioural treatment; legal advice or representation; formal mediation; emergency response; or statutory entitlement decisions. The Professional Scope Statement forms part of the public information supporting these Terms. Where another professional is better placed to help, TNDH may recommend referral or collaboration.6. Quotations, proposals and agreementsBefore paid work begins, TNDH will normally provide written confirmation of the agreed service, purpose, main activities or deliverables, fees, payment arrangements, expected timeframe, relevant responsibilities and any material exclusions or dependencies.A quotation is valid for the period stated in it and may be withdrawn or amended before acceptance.Material additions or changes to the agreed scope may require a revised quotation, additional fee or new agreement.7. Fees, payment and invoicesFees will be agreed before the paid service begins and are normally quoted in UAE dirhams.TNDH currently accepts payment by bank transfer or cash.Payment is normally due before a package begins unless a different staged, session-by-session or case-specific arrangement is agreed in writing. TNDH may pause or postpone work while an agreed payment remains overdue.TNDH will provide a detailed invoice or payment record containing the required business, service and transaction information. Where UAE requirements apply, invoice information will be issued in Arabic, with English added where appropriate.Bank transfers are processed through the Client’s and TNDH’s banking providers. The Client is responsible for any bank charges that have been clearly disclosed or imposed by their own bank.8. Relationship-first and staged engagementTNDH recognises that effective work may depend on fit, trust, participation, communication and the way a child, young person, adult or family responds to the working relationship.Where appropriate, TNDH may recommend beginning with a paid consultation, individual session or short agreed trial period before a larger package is confirmed.A trial or initial stage does not guarantee continued work and does not require either party to proceed to a larger package. The next step will be decided using the Participant’s response, professional scope, safety, practical suitability and the Client’s priorities.9. Sessions and packagesWhere sessions are purchased as a package, the number and type of sessions, payment arrangement, any validity period and relevant cancellation terms will be confirmed before payment.A package will not expire under an undisclosed expiry condition. Packages are intended for the named Client or Participant and may not be transferred without written agreement. The sequence, intensity, setting or format may be adapted where participation, access, safety, evidence or practical circumstances indicate that a change is needed. Material changes will be discussed with the Client.10. Client cancellation and reschedulingClients should normally provide at least 24 hours’ notice when cancelling or requesting to reschedule a paid consultation or scheduled session.A session cancelled with less than 24 hours’ notice, or missed without notice, may be charged in full or counted as a completed package session. TNDH will consider emergencies and exceptional circumstances case by case.Where a Client arrives late, the session may still end at the scheduled time so that later appointments and commitments are protected.
11. Cancellation by TNDHWhere TNDH must cancel a paid session or agreed activity, the Client will be offered an appropriate replacement appointment, credit, alternative arrangement or refund for the service TNDH was unable to provide.TNDH is not responsible for reasonable additional costs incurred by the Client unless those costs were agreed in advance.12. RefundsCompleted services are not normally refundable merely because a Client changes their mind or because an outcome that was not guaranteed has not occurred. This does not remove any mandatory consumer right.Where a prepaid package ends before completion, any refund for genuinely unused work will normally be calculated after deducting: services already delivered; late-cancelled or missed sessions properly chargeable under these Terms; bespoke preparation or document work already completed; and clearly disclosed non-recoverable third-party costs.Where a package discount was expressly conditional on completing the package, delivered sessions may be recalculated at the standard individual-session rate only if that method was disclosed before purchase.Where TNDH has not provided an agreed service properly, TNDH will review the circumstances and may correct or repeat the affected work, provide a credit, issue a partial refund or issue a full refund for the affected service, as appropriate.13. Client responsibilitiesThe Client agrees to provide information that is accurate and relevant; disclose significant safety, access or participation information; identify who has authority to provide consent; obtain necessary permissions before asking TNDH to contact another setting or professional; pay agreed fees when due; and treat Participants and all parties respectfully. The Client should raise concerns, changes or misunderstandings promptly and avoid presenting TNDH advice, reports or documents misleadingly or outside their intended purpose.A Client is not required to agree with every recommendation. Disagreement, uncertainty or implementation difficulty may be discussed without penalty.14. Consent, assent and participationWhere a service concerns a child or young person, an appropriately authorised parent or legal guardian must provide consent. TNDH will also seek the child or young person’s views and assent in an accessible and developmentally appropriate way wherever possible.Where a service concerns an adult, the adult Participant’s consent and involvement will normally be required. If another person arranges the service, TNDH may require evidence of authority and will still seek to involve the Participant meaningfully wherever possible.Refusal, withdrawal, discomfort or distress will be treated as meaningful information. TNDH may pause or adapt an activity where participation, welfare or safety is in question.15. Safety, health information and supervisionSafety and supervision responsibilities depend on the setting and will be clarified where necessary.Unless expressly agreed otherwise, a parent, guardian, school, club or host organisation remains responsible for its premises, staff, emergency procedures and general supervision. TNDH does not take over the legal responsibilities of a parent, school, club, employer or regulated professional.Where physical activity is involved, the Client must provide relevant health and safety information. TNDH may adapt, pause or stop an activity where the environment or circumstances are unsafe or where medical clearance or another professional opinion is needed.16. Third-party settings and decisionsTNDH may work within or communicate with homes, schools, clubs, workplaces, community programmes and other services where authorised.TNDH cannot guarantee that another person or organisation will accept or implement a recommendation, permit access, maintain agreed conditions or reach a particular decision. Each third party remains responsible for its own legal duties, policies, staff, facilities and actions.
17. Communication and availabilityCommunication may take place by email, telephone, video call, WhatsApp Business or face-to-face meeting, as agreed.Messages are not monitored continuously and must not be used for emergencies. Reasonable professional boundaries may apply to response times, contact outside scheduled work, extensive document review, multi-party liaison and work beyond the agreed scope.Additional work may require an additional fee where it goes beyond the agreed service.18. Privacy, confidentiality and safeguardingTNDH processes personal information in accordance with the Privacy Notice and treats service information confidentially.Confidentiality is not absolute. Information may be shared where the Client has authorised it; sharing is necessary to provide the agreed service; there is a serious safety or safeguarding concern; disclosure is required or permitted by law; it is necessary to establish or defend legal rights; or information has been properly anonymised.TNDH will not promise secrecy where safeguarding or legal duties may require action. Where a concern suggests abuse, neglect, exploitation, significant risk or immediate danger, TNDH may pause the service, record the concern and share necessary information with an appropriate safeguarding contact, service or authority.19. Educational testing, observations and reportsEducational tests, observations and reports are used only for the purpose stated in the agreement and within the practitioner’s qualifications, competence, publisher requirements and authorisations.Unless explicitly stated otherwise, they are non-diagnostic and do not constitute medical, psychological or clinical conclusions. Scores are not complete descriptions of a person and must be interpreted within their context and limitations.Reports must not be altered, selectively reproduced or used outside their stated purpose in a way that is misleading.20. Intellectual propertyUnless otherwise agreed in writing, TNDH retains ownership of its original frameworks, methods, templates, training materials, visual designs, resources, reports, document structures, terminology, branded systems and unpublished tools. After full payment, the Client may use final materials supplied to them for the personal or internal organisational purpose stated in the agreement. The Client may not sell or commercially redistribute TNDH materials; publish editable proprietary templates; remove ownership notices; present TNDH material as their own; reproduce branded frameworks without permission; or materially alter a report while continuing to represent it as an original TNDH document. The Client retains ownership of materials they provide to TNDH.21. Outcomes and limitationsTNDH will provide agreed services with reasonable care and within professional scope.Educational, developmental, organisational, fitness and participation outcomes depend on multiple factors, including environmental conditions, relationships, opportunity, implementation, consistency, health, attendance, resources, third-party decisions and changing circumstances.TNDH does not guarantee a diagnosis, score, level of progress, school or organisational decision, implementation by others, elimination of all barriers or a particular educational, behavioural, fitness, commercial or participation outcome. The absence of a guaranteed outcome does not remove TNDH’s responsibility to provide the agreed service properly.22. Pausing or ending an engagementThe Client may end an engagement by providing written notice, subject to the agreed payment, cancellation and refund provisions.TNDH may pause or end an engagement where fees remain overdue; the service is no longer appropriate or within scope; necessary consent, authority or cooperation is unavailable; safety or safeguarding concerns cannot be managed; abusive, discriminatory or threatening conduct occurs; continuing would be unethical or unlawful; or another professional is more appropriately placed.TNDH will not end a service merely because a Client disagrees with a recommendation. Where reasonably possible, TNDH will explain the reason and support an appropriate transition or referral.
23. ComplaintsClients are encouraged to raise concerns promptly. Complaints will be handled under the TNDH Complaints Procedure.Raising a complaint will not result in retaliation or unfair treatment and does not prevent a Client from contacting an appropriate consumer-protection, regulatory or legal authority.24. LiabilityNothing in these Terms excludes or limits liability or consumer rights where doing so would be unlawful.Subject to applicable law, TNDH will not normally be responsible for indirect or consequential loss that was not reasonably foreseeable; actions or omissions of third parties; changes made to recommendations or materials without approval; use of a report outside its stated purpose; or outcomes arising from information that was materially inaccurate or withheld. This section does not excuse TNDH from responsibility for providing the agreed service with reasonable care.25. Events outside reasonable controlNeither party will be treated as in breach for a reasonable delay caused by circumstances outside their control, including serious illness, government restrictions, extreme weather, interruption of essential systems or other significant unforeseen events. The affected party should communicate promptly and take reasonable steps to reduce disruption.26. Changes to these TermsTNDH may update these Terms to reflect changes in services, systems or applicable requirements. The version accepted at the beginning of an engagement will normally continue to govern that engagement unless the change is required by law, necessary for safety or safeguarding, or agreed by both parties.27. Governing lawThese Terms are governed by the applicable laws of the United Arab Emirates and the Emirate of Abu Dhabi.Any dispute that cannot be resolved through the complaints process may be referred to the competent authorities or courts in Abu Dhabi, subject to any mandatory consumer right or jurisdictional requirement.28. 1. Our commitmentThe Neurodiverse Home™ aims to provide clear, respectful and professionally responsible services. Concerns and disagreement can arise, and a complaint will be taken seriously.Raising a complaint will not result in retaliation, unfair treatment or automatic withdrawal of service. Complaints are also used to identify implementation and organisational learning.2. What may be raisedA concern or complaint may relate to communication; professional conduct; service quality; fees or invoices; cancellation or refund decisions; privacy or information handling; accessibility; safeguarding practice; professional scope; an assessment, report or recommendation; failure to provide an agreed service; or how an earlier concern was handled.A complainant does not need to use legal or technical language.3. Informal resolutionWhere appropriate, the quickest first step is to raise the concern directly with Anthony Keene. Many concerns can be resolved through clarification, correction, apology, adaptation, an agreed action, repetition of affected work or review of a fee or decision.A person may proceed directly to a formal complaint where the issue is serious or an informal conversation would not be appropriate.4. Making a formal complaintEmail [email protected] with the subject line “Formal Complaint”.Where possible, include your name; the Participant or organisation involved; what happened; relevant dates; what has already been done; the outcome you are seeking; and any accessibility or communication support required.A complaint may also be submitted by voice note, telephone or another accessible format where writing creates a barrier.5. AcknowledgementTNDH will normally acknowledge a formal complaint within two working days. The acknowledgement will confirm receipt, whether more information is needed and the expected response date.
6. ReviewThe complaint will be reviewed fairly and proportionately. This may involve reviewing correspondence, agreements, invoices and records; asking for clarification; speaking to another relevant person where appropriate and authorised; separating established facts from interpretation; and considering contractual, professional, privacy, safety and consumer issues.Only information reasonably necessary to review the complaint will be used.7. ResponseTNDH will normally provide a written outcome within ten working days of receiving sufficient information.Where more time is needed, TNDH will explain the reason, what remains to be reviewed and when a response is expected. The response will normally identify the issues considered, information reviewed, findings, whether the complaint is upheld or partly upheld, any action or remedy, relevant learning and how to request reconsideration.8. Possible outcomesDepending on the circumstances, an outcome may include clarification; correction; apology; revised report or document; change in communication or procedure; completion or repetition of affected work; credit; partial or full refund; referral; responsible ending of the engagement; or no further action where the available information does not support the complaint.A particular remedy cannot be guaranteed before the complaint has been reviewed.9. ReconsiderationA complainant who believes significant information was overlooked may request reconsideration within ten working days of the outcome. The request should identify the issue, the information believed to have been overlooked and why it may change the outcome.Because TNDH is a founder-led sole establishment, a completely independent internal appeal may not always be possible. Where appropriate, TNDH may seek external professional advice or propose review by a suitable independent person.10. Safeguarding and urgent concernsA concern involving immediate danger, abuse, neglect, exploitation or serious risk will not wait for the ordinary complaints timetable. TNDH may take immediate safeguarding action and share necessary information with appropriate services or authorities.TNDH is not an emergency service.
11. Privacy complaintsPrivacy complaints will be reviewed under both this Procedure and the Privacy Notice. TNDH may need to verify identity or authority before releasing personal information.12. Records and confidentialityTNDH will maintain a proportionate record of the complaint, information reviewed, decisions, communication, actions and relevant learning.Complaint information will be shared only where reasonably necessary to review, respond, protect safety or meet a legal requirement.13. External escalationUsing this Procedure does not remove the right to contact an appropriate external authority. For complaints concerning a business licensed in Abu Dhabi, consumers may contact Abu Dhabi consumer protection through TAMM or the Abu Dhabi Government Contact Centre on 800555.A complainant may also seek independent legal advice or use any competent regulatory authority or court available under UAE law.14.
